In this cause a summons has been sued out under T.C.A. 13-6-106, for abatement of a public nuisance. Plaintiff has asserted that Onyx Collierville Hotel, LLC, Onyx Hospitality, LLC ("Onyx"), and 10330 Collierville Rd, Collierville TN, Tax Parcel C0257 00522, is a public nuisance and has requested an Order of Compliance from this Court.

All owners and interested parties shall be put on notice, in accordance with Tenn. Code Ann. §13-6-106(c) in pertinent part that, the filing of a petition shall "(1) Create a receiver's lien that secures an undetermined amount until the court establishes the amount. .. ; (2) Act as a bar of any transfer of title of the subject parcel or of any interests pertaining to such subject parcel, including, but not limited to, transfers by tax sale or other foreclosure, transfers or creation of lien interests in the subject parcel, or otherwise, from the date of the filing until the petition is dismissed or until specific orders of the court authorizing a transfer of title, if the petitioner has attached a certificate of public nuisance issued pursuant to subsection (a); and (3) Authorize the municipal corporation, in its discretion, to access the subject parcel for boarding, securing, and maintaining the subject parcel at any time if it has been determined by the court that the owner has failed to do so. Any costs incurred by the municipal corporation shall be charged to the owner. Tenn. Code Ann. § 13-6-106(c).

I. INTRODUCTION

The Tennessee Golf Foundation (TGF) is soliciting proposals from qualified firms to provide Construction Manager-at-Risk (CMAR) services in connection with the construction of the New Clubhouse for The Links at Audubon Golf Course (The Project). The successful firm will be asked to assist TGF with routine and customary CMAR services as set forth in T. C. A. § 12-4-107 and more fully described below. Procurement of the CMAR will be based on the firm’s qualifications and experience on similar projects, qualifications of personnel to be assigned to the project, fees and costs, and the additional criteria set forth in the RFP.

II. PROJECT DESCRIPTION

The Tennessee Golf Foundation wishes to construct a new, ground-up clubhouse to replace its temporary clubhouse facility currently serving the Links at Audubon golf course located on Cherry Road in Memphis, Tn. The new 21,325 SF clubhouse will become the central hub of the course and the home of the First Tee of Memphis Headquarters. The facility thoughtfully integrates a pro shop, full-service restaurant, and concessions to serve players and visitors, while advancing youth golf and educational programming through the First Tee.

The two-story design features a Memphis Golf Hall of Fame corridor that celebrates the City’s rich golf legacy alongside emerging junior talent, complemented by administrative offices, a flexible multi-use room, an indoor golf practice simulation suite, and essential support spaces—collectively establishing a dynamic destination for golf, learning, and community engagement. Site work involves incorporating and modifying the existing parking lot to serve the new building along with other site, utility and landscaping improvements.

The existing golf course and current temporary clubhouse facility shall remain 100% operational during all construction activities for the duration of the project. The selected respondent shall coordinate all work activities, schedules, staging areas, material deliveries, contractor parking, site access and all other construction-related activities with the Links of Audubon staff to ensure uninterrupted continuity and avoidance of conflicts with golf course play and operations.

The project is estimated to have a 12-month construction timeline. Construction is scheduled to begin on or before July 1, 2026 and be completed on or before June 30, 2027.

The construction budget for the project is estimated to be $14.5 million including site work and Owner’s contingency.

III. PROJECT DESIGN TEAM

4F Design (“Consultant”) is providing A/E services. The selected CMAR will coordinate with the project design team for the duration of the project.

If a State of Tennessee Contractor’s license is required, the Contractor’s license monetary

limits must meet or exceed the Contractor’s bid price.

MLGW shall give Local Bidding Preference or Local Bidding Presence in the awarding of contracts and making purchases whenever applying such a preference is reasonable in light of the dollar- value of the bids received in relation to such expenditures. For Local Bidding Preference or Local Bidding Presence to be used in evaluating bids, all documentation as required in the Local Bidding Preference or Local Bidding Presence Policy must be submitted with the Bidder’s qualifications.

MLGW is subject to the Tennessee Public Records Act. Your bid may be examined by the public after it has been evaluated by MLGW and an award has been made.

This project is exempt from the mandatory contractor’s licensing requirements if the bid amount is under $25,000.

If the bid amount is under $25,000, the phrase “Exempt from licensing requirement” must appear in the Tennessee License number space on the preprinted bid envelope provided. However, other required information (e.g., Project title, contractor’s company name, contractor’s address, and bid due date) must be completed.

PUBLIC NOTICE

Cargill, Inc. has applied to the Shelby County Health Department, Pollution Control Section, to renew their Title V major source operating permit (Permit No. 00045-01TV) for their corn oil extraction and refining facility.

This facility is subject to the provisions of Shelby County Code Section 16-77 [Reference Rules and Regulations of Tennessee, Rule 1200-3-9-.02 (11)] (commonly referred to as the Title V regulations). A Title V operating permit is required by the Federal Clean Air Act and the City of Memphis Code. The Cargill, Inc. facility is located at 2330 Buoy Street, Memphis, Tennessee. Operations at this facility consist of oilseed preparation, solvent extraction, oil refining, and associated support operations.

The requested renewal includes an update to the facility’s insignificant activities. The facility is not increasing their emission limits and there will be no impact to ambient air quality resulting from the renewal and administrative amendment. The Department intends to issue the renewed and amended permit.

When submitting comments that reference research paper, articles, or other sources, commenters must provide the following: (1) a copy of the full referenced material (preferably in PDF format); (2) sufficient background context from the cited source: and (3) a concise explanation of how the cited material supports the commenter’s position.

A copy of the application materials used by the Department and a copy of the draft permit are available for public inspection at the Pollution Control Section office during normal business hours (8:00 am – 4:30 pm).

A copy of the application evaluation document and a copy of the draft permit are available on the Shelby County Health Department website at http://www.shelbytnhealth.com/310/Air-Pollution-Control-Public-Notices. Interested parties are invited to review these materials and provide written comments. In addition, a public hearing may be requested at which written or oral presentations may be made.
