Any costs incurred by the municipal corporation shall be charged to the owner. Tenn. Code Ann. § 13-6-106(c).

During the solicitation of this Sealed Bid, potential Bidders shall not contact any MLGW staff except those designated in this document or subsequent addenda or correspondence. All bidders must be licensed Contractors as required by Title 62, Chapter 6, of the Tennessee Code Annotated. If a State of Tennessee Contractor’s license is required, the Contractor’s license monetary limits must meet or exceed the Contractor’s bid price.

MLGW shall give Local Bidding Preference or Local Bidding Presence in the awarding of contracts and making purchases whenever applying such a preference is reasonable in light of the dollar value of the bids received in relation to such expenditures. For Local Bidding Preference or Local Bidding Presence to be used in evaluating bids, all documentation as required in the Local Bidding Preference or Local Bidding Presence Policy must be submitted with the Bid, Bid Bond, and Bidder’s qualifications; provided, however, that the preference established in no way limits MLGW’s right to make awards.

MLGW is subject to the Tennessee Public Records Act. Your bid may be examined by the public after it has been evaluated by MLGW and an award has been made.

This project is exempt from the mandatory contractor’s licensing requirements if the bid amount is under $25,000.

If the bid amount is under $25,000, the phrase “Exempt from licensing requirement” must appear in the Tennessee License number space on the preprinted bid envelope provided. However, other required information (e.g., Project title, contractor’s company name, contractor’s address, and bid due date) must be completed.

The Bidder’s Qualifications must be submitted with a reference letter as listed in the Bidder’s Qualifications. Before the execution of the contract, the successful Bidder shall furnish, according to the Tennessee Code Annotated § 12-4-201, a Contractor’s Labor and Materials Payment Bond in a determined sum of no less than 25% of the bid price. The bond shall be made upon the form provided by MLGW in this packet and shall be made part of the Contract Documents. Such a surety shall be acceptable to MLGW.

All contract bonds shall be written through a surety company duly authorized to do business in Tennessee.

No bidder may withdraw a bid for a period of 120 days after the date and hour set for the opening of bids.

Notice is hereby given, pursuant to Tennessee Statute Section 16-19-104, the City of Lakeland, Tennessee, will receive sealed bids until 2:00 p.m., local Time, March 31, 2026, for the following: BRODY TOWNSEND ATHLETIC COMPLEX RESTROOM PROJECT

Bids must be in one sealed envelope with statement thereon "BID ENCLOSED, BRODY TOWNSEND ATHLETIC COMPLEX RESTROOM PROJECT" and be submitted to the receptionist at the City of Lakeland, Tennessee 10001 U.S. Highway 70, at or before the above stated time. Bids will be opened publicly, read aloud, and tabulated by the City Manager, or his or her Designee, at the above stated time and place, unless an alternative site is designated in writing prior to the time of Bid Opening. No bid may be withdrawn for a period of thirty (30) days after the date set for opening thereof. The City of Lakeland, Tennessee reserves the right to reject any or all bids and to waive any informalities or technicalities in the bidding; provided, however, that any bid received after the time specified or without accompanying Bid Guaranty, as stated below, will not be considered.

The scope of work is to furnish supervision, labor, transportation, equipment and materials for structural repairs at various locations on the fourth and fifth levels of the MLGW Beale Street Landing Garage located at 245 South Main Street, Memphis, TN 38103 as outlined in the Contract Document and Specifications.

During the solicitation of this Sealed Bid, the Consultant shall not contact any MLGW staff except those designated in this document or subsequent addenda or correspondence. Noncompliance with this provision may result in the rejection of your firm’s bid. No phone calls related to the Sealed Bid will be accepted.

All bidders must be licensed contractors as required by Title 62, Chapter 6, of the Tennessee Code Annotated. The following information must be completed on the outside of the preprinted Bidder’s Envelope: Bidder’s Name, Bidder’s license number, expiration date, and that part of the classification applying to the bid (e.g., electrical, plumbing, heating, ventilation, and air conditioning). If the preceding information is not completed, the bid shall not be opened or considered by MLGW.

The Tennessee Contractor’s Classification required for this project shall be one of the following or any Tennessee-approved contractor’s license applicable to this project: N/A

If a State of Tennessee Contractor’s license is required, the Contractor’s license monetary limits must meet or exceed the Contractor’s bid price.

MLGW shall give Local Bidding Preference or Local Bidding Presence in the awarding of contracts and making purchases whenever applying such a preference is reasonable in light of the dollar- value of the bids received in relation to such expenditures. For Local Bidding Preference or Local Bidding Presence to be used in evaluating bids, all documentation as required in the Local Bidding Preference or Local Bidding Presence Policy must be submitted with the Bidder’s qualifications.

MLGW is subject to the Tennessee Public Records Act. Your bid may be examined by the public after it has been evaluated by MLGW and an award has been made.

This project is exempt from the mandatory contractor’s licensing requirements if the bid amount is under $25,000.

If the bid amount is under $25,000, the phrase “Exempt from licensing requirement” must appear in the Tennessee License number space on the preprinted bid envelope provided. However, other required information (e.g., Project title, contractor’s company name, contractor’s address, and bid due date) must be completed.

The Bidder’s Qualifications must be submitted by reference letter as listed in the Bidder’s Qualifications. The Bidder’s Qualifications must indicate the Contract Number C2954 and title on the front page of Bidder’s Qualifications and so noted on the outside of the envelope.

If after attempting to obtain competitive bids for material or services, only one (1) bid is received and that bid does not exactly meet our specifications or budgetary limits, the Procurement and Contracts Management staff shall have the authority to negotiate with the bidder to secure an acceptable bid.

Any protest must be filed in writing with the Manager of Procurement and Contracts by 5:00 PM CST/CDT within five (5) business days of the Notification of the Intent to Award Letter or non-award incident.
