The State of Tennessee, Department of Children’s Services, has filed a petition against you seeking to terminate forever your parental rights to Jose’ Emanuel Cabrera Irias aka Jose Emanuel Cabrera on the grounds that you have willfully abandoned this child and for other reasons. It appears that ordinary process of law cannot be served upon you because your whereabouts are unknown. You are, therefore, ordered to respond by appearing in Court or filing an Answer to the Petition filed against you. A copy of the Petition may be obtained at the office of the Juvenile Court of Madison County, 110 Irby Street, Jackson, Tennessee 38301. This notice will be published for four consecutive weeks. The last date of publication will be July 31, 2026. You must appear in Court on September 1, 2026 at 1:30 p.m. to defend or file an Answer within 30 days of the last publication, or a Default Judgment or judgment on the facts will be taken against you and a hearing to terminate your parental rights will be set. The project scope is to provide supervision, labor, transportation, equipment, chemicals, tools, and materials necessary to expand and improve MLGW’s existing North Service Center located at 1060 Tupelo Street, Memphis, TN 38108, to incorporate the relocation of the Central Shops Facilities. The improvements include the management and mitigation of known soil contaminants in two (2) distinct areas of the properties described in the contract documents. Additionally, the project will construct a 100,000 sf and 63,000 sf maintenance and storage building, nearly 400,000 sf of asphalt parking and driveways, 34,000 sf of gravel laydown and storage areas, major utility relocation, 15,000 sf of iron security fencing with landscaping and irrigation, two (2) controlled gated entries with guard houses, multiple vehicle wash bays, and various other training, storage, and maintenance features.

The construction of this project is phased to ensure ongoing operations are not interrupted at the North Service Center. The First Phase includes the installation of the perimeter fencing, construction of the two (2) entrances with new guard houses, construction of new parking lots, and construction of the new storage and laydown areas. Existing utilities will be relocated and abandoned as prescribed in the contract, and new drainage will need to be installed to allow for the abandonment of some of the existing drainage systems. There will be a period when existing materials will need to be relocated to clear the areas where the new maintenance and storage buildings will be constructed. The Final Phase will include the construction of both buildings and all remaining features and appurtenances described in the construction documents. The work must be performed in strict accordance with the Contract Documents, Specifications, and Drawings.

Bidders must submit a letter from their surety on the surety’s letterhead stating the Contractor has a single project bonding capacity of $100,000,000.00, naming three (3) projects exceeding a $35,000,000.00 contract amount for which the surety has issued Payment and Performance Bonds for any Owner within the past ten (10) years. The bonded projects can be current ongoing projects. Additionally, Bidders must provide proof of possessing a minimum of ten (10) years of construction experience. ORDINANCE NO. 586

JOINT ORDINANCE AMENDING THE 2021 MEMPHIS AND SHELBY COUNTY BUILDING CODE SO AS TO AMEND STORM SHELTER REQUIREMENTS FOR EDUCATIONAL BUILDINGS AND ADD A NEW APPENDIX RELATING TO OPTIONAL MIDDLE-SCALE HOUSING CONSTRUCTION REQUIREMENTS. SPONSORED BY COMMISSIONER DAVID C. BRADFORD, JR.

 WHEREAS, The Shelby County Board of Commissioners and the Council of the City of Memphis seek to maintain a comprehensive set of coordinated Technical Codes and to update those Codes to assure the safe and effective construction of commercial buildings and structures in the Community; and

 WHEREAS, Provisions of the Tennessee Code Annotated require local jurisdictions wishing to operate their own program for permitting and inspection of construction activities, rather than State control of those activities, to review and update their locally adopted Building and technical codes on a regular cycle to assure they are providing an adequate level of public safety; and

 WHEREAS, Copies of the 2021 Edition of the /CC International Building Code have been placed in the Offices of the Minutes Clerk of the Shelby County Commission and of the Memphis City Council for public review, as required by state law; and

 WHEREAS, The adoption of this amendment to the Memphis and Shelby County Building Code will require the affirmative vote of the majority of the Shelby County Board of Commissioners and the Council of the City of Memphis as no new fine is established by this adoption and update.

 NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF SHELBY COUNTY, TENNESSEE, That the first sentence of Section 423.5 Group E occupancies of the Memphis and Shelby County 2021 Building Code is deleted and replaced with, “In areas where the shelter design wind speed for tornados is 250 mph in accordance with Figure 304.2(1) of ICC 500, all Group E occupancies with an occupant load of 50 or more may have a storm shelter. If a storm shelter is constructed, it shall be constructed in accordance with ICC 500.”

 BE IT FURTHER ORDAINED, That Appendix M relating to optional middle-scale housing construction requirements, as further described in Exhibit A, is adopted into the Memphis and Shelby County Building Code.

 BE IT FURTHER ORDAINED, That Chapter 6, Article II, of the Shelby County Code of Ordinances, currently encoded at Sections 6-41, et seq., is amended to make such changes as necessary to reflect these amendments, in accordance with the changes shown in Exhibit A attached hereto and incorporated herein by reference.

 BE IT FURTHER ORDAINED, That should any part of this Ordinance or Code be found to be unlawful or unenforceable by a court of competent jurisdiction that such a determination will have no effect on the other portions of the adopted Code and the amendments thereto.

 BE IT FURTHER ORDAINED, That this Joint Ordinance shall take effect in the City of Memphis and the unincorporated areas of Shelby County on December 31, 2025, by virtue of the concurring and separate passage thereof by the Board of Commissioners of Shelby County and the Memphis City Council, or if not adopted by each legislative body by that date, then at the date of adoption by the last adopting body.
