Separate sealed BIDS for the construction of Project #2 – EAST SIDE REVITALIZATION OF TAXILANE AND VEHICULAR ACCESS ROAD will be received by the Millington Airport Authority, Tennessee, hereinafter referred to as the OWNER, at the Airport Conference Room until 2:30 P.M., local time, THURSDAY, MAY 14, 2026. The Work includes the following principal items: Milling, paving, and marking operations.

A Pre-Bid Conference will be held at 2:00 P.M. local time, THURSDAY, APRIL 30, 2026, at the Millington Airport Authority, 8182 Hornet Avenue, Millington, Tennessee 38053. Due to the importance of all bidders having a clear understanding of the scope and requirements for this contract, it is strongly encouraged that bidders attend this meeting. Any changes that may be agreed upon as a result of this meeting will be noted in an addendum sent to all plan holders.

Total Contract Time for completion of the work is sixty (60) calendar days.

Liquidated damages for delay will be in the amount of $2,500.00 per calendar day that the project remains incomplete after the specified completion time.

Contract Security: The Successful BIDDER will be required to furnish separate performance and payment bonds payable to the OWNER. Each bond shall be in an amount equal to 100% of the Contract Price as security for CONTRACTOR'S faithful performance and payment of all obligations under the Contract Documents.

No BID may be withdrawn by the BIDDER within one hundred and twenty (120) days after actual date of opening thereof.

BIDS in the case of corporations not chartered in Tennessee, must be accompanied by proper certificate evidencing that such corporation is authorized to do business in the State of Tennessee.

Bids are to be based upon prevailing wages in Shelby County, Tennessee; and in no case are wages considered less than those predetermined by the Secretary of Labor, a schedule of which is contained in the Contract Documents.

The Successful BIDDER whether a resident or nonresident shall be required to comply with all City, County and State licensing and/or permit laws.

Any contract(s) awarded pursuant to this ADVERTISEMENT FOR BIDS may be funded in part by a grant from the U.S. Department of Transportation, Federal Aviation Administration. Trade Restriction Certification

By submission of an offer, the Offeror certifies that with respect to this solicitation and any resultant contract, the Offeror –

Prohibition of Covered Unmanned Aircraft Systems (UAS)

The Bidder or Offeror certifies that they are aware of and comply with relevant Federal statutes and regulations, including those from the Federal Aviation Administration (FAA), for operating unmanned aircraft systems (UAS) in accordance, and in compliance with all related requirements in the FAA Reauthorization Act of 2024 (Public Law 118-63), section 936 (49 U.S.C. § 44801 note).

Contractor warrants that all UAS operations will be conducted in full compliance with all applicable Federal Aviation Administration (FAA) regulations, including but not limited to 14 CFR Part 107, and any other applicable local, state, or Federal laws and regulations. 

Sponsors and subgrant recipients cannot use AIP grant funds to enter into, extend, or renew a contract related to covered unmanned aircraft systems (UAS). This includes both procurement and operational contracts, as well as contracts with entities that operate such systems.

The Tennessee Department of Environment and Conservation (TDEC), Division of Land Protection – Waste Management Section (Division), has tentatively decided to issue a solid waste composting facility permit major modification to the existing City of Memphis for the Earth Complex Composting and Recycling Center (CMP790000011).

The facility, identified as the Earth Complex Composting and Recycling Center (CMP790000011), is located in Shelby County at 2389 Hennington Avenue, Memphis, Tennessee (latitude 35.064306 N/longitude -90.144801 W). This permit would allow for expansion and continuance of construction, operation, and closure of the Tier II composting facility for waste materials classified as ground yard waste from commercial landscapers, the general public, and public works organizations, as well as pre-consumer and post-consumer food waste originating from residential, commercial, and industrial sources, including, but not limited to, homes, restaurants, produce packing, animal processing, and grocery stores, and/or certain wastes having similar characteristics and approved in writing by TDEC. This major modification specifically allows compost operations to extend onto two adjacent parcels adding the potential for 9.2 acres of additional operational area. No hazardous wastes, as regulated by the Tennessee Hazardous Waste Management Act (Tennessee Code Annotated, Section 68-212-101, et. seq.) and the Rules adopted pursuant to the Act, shall be accepted for disposal at this facility. The official responsible for operation of the facility is Mr. Philip Davis, City of Memphis Solid Waste Director, 125 North Main Street, Room 628, Memphis, TN 38103 (901-576-6872).

The Division has made a preliminary determination that the City of Memphis’ application meets the applicable requirements of Tennessee Rule Chapter 0400-11-01, Solid Waste Processing and Disposal. Pending consideration of any comments received during the 45-day comment period, the Division intends to issue this permit modification.

Comments must be received by 4:30 p.m. CST on Monday, June 1, 2026, to assure consideration. A request for a public hearing must be in writing and state the nature of the issues proposed to be raised in the hearing. If a hearing is scheduled, another notice will be published at least 15 days in advance of the hearing.

After considering all public comments, the Division will make a final decision to issue or deny the permit. The Division will provide notice of the final permit decision and a Response to Comments addressing all significant input received on the draft permit to the applicant and to each person who has submitted written comments. These documents will also be available online and at the repositories listed above.
