The project scope is to provide engineering, permitting, site work, and electrical activities to facilitate the installation of ChargePoint electric vehicle charging equipment to be operated by Memphis Light, Gas, and Water. The installation, commissioning, and activation of the ChargePoint charging equipment is not included in this scope of work; however, the EV charging equipment foundation templates will be provided by MLGW for anchor bolt and electrical conduit installation to be completed by the successful Contractor. The successful Contractor shall include all labor, material, equipment, and insurance to complete the work as depicted in strict accordance as outlined in the Contract Documents, Specifications, and Drawings.

The Contract is separated into two (2) locations:

?        Memphis-Orleans Station – 714 Madison Avenue, Memphis, TN 38103

This project will provide the necessary provisions for the subsequent installation of four (4) ChargePoint Express 280 dispensers for a combined site power output of 320kW.

?        Collierville – 187 Washington Street, Collierville, TN 38017

This project will provide the necessary provisions for the subsequent installation of three (3) ChargePoint Express Plus Power Link dispensers and four (4) ChargePoint Express Plus Power Block rectifying cabinets for a combined site power output of 800kW.

?        The make-ready scope of work for both locations must be completed by no later than June 5, 2026. The total project must be completed before June 30, 2026.

Note: Contractors must provide pricing for both locations: 1). 714 Madison Avenue, Memphis, TN, 38103, and 2). 187 Washington Street, Collierville, TN 38017, to be considered for the award. Failure to provide pricing for both locations of this contract will deem your bid non-compliant, and your bid will not be considered for award.

Information to Bidders:

This project is funded in part under a grant contract with the State of Tennessee’s Department of Environment and Conservation, under the State of Tennessee Volkswagen Diesel Settlement Environmental Mitigation Trust Fast Charge TN Network Grant Program. Therefore, certain restrictions and other state requirements are attached to this opportunity.

Per the TDEC grant: Subcontracting. The Respondent shall not assign this Grant Contract or enter into a subcontract for any of the services performed under this Grant Contract without obtaining the prior written approval of the State. If such subcontracts are approved by the State, each shall contain, at a minimum, sections of this Grant Contract pertaining to "Conflicts of Interest," “Lobbying,” "Nondiscrimination," "Public Notice,” and "Records" (as identified by the section headings). Notwithstanding any use of approved subcontractors, the Respondent shall remain responsible for all work performed.

The Tennessee Contractor’s Classification required for this project shall be one of the following or any Tennessee-approved contractor’s license applicable to this project: CE, or CE-C.

 NOTICE IS HEREBY GIVEN that Corbin I. ORDINANCE NO. 585

ORDINANCE AMENDING THE SHELBY COUNTY CHARTER TO AMEND: (1) ARTICLE V, SECTION 5.24 RECALL OF ELECTED COUNTY OFFICERS, AND (2) ARTICLE VI, SECTION 6.02 COUNTY BOARD OF EDUCATION. SPONSORED BY COMMISSIONER ERIKA SUGARMON AND COMMISSIONER MICKELL LOWERY.

WHEREAS, The state law authorizing the establishment of a charter form of County government requires that the charter document contains the rights, powers, duties, obligations or functions of any officer, agency or office of the County in order for them to be continued in the charter form of County government; assign administrative and executive functions to the officers of County government; and provide for the titles, qualifications, compensation, method of selection, tenure, removal and replacement of administrative and executive officers of County government; and

WHEREAS, The Shelby County Board of Commissioners has proposed amendments to the Shelby County Charter as recited herein and same should be published and submitted to the voters of Shelby County in accordance with the state election laws during the next Countywide election allowed by law; and

WHEREAS, The Shelby County Board of Commissioners now desires to amend the Shelby County Charter as described herein; and

WHEREAS, To the extent permitted by law, the language requirements are governed by Section 203 of the Voting Rights Act, the referendum must be translated into the top five languages spoken in Shelby County; and

WHEREAS, State law requires the County Attorney to prepare a summary not to exceed 200 words in length when the full statement of the proposed amendments exceed 300 words in length; and

WHEREAS, The full statement of the proposed amendments do not exceed 300 words in length and, therefore, should be published and submitted to the voters in its entirety.

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF SHELBY COUNTY, TENNESSEE, That the Shelby County Charter may be amended pursuant to Article V, Section 5.05 of the Shelby County Charter.

BE IT FURTHER ORDAINED, That the following proposed amendment to the Shelby County Charter shall be submitted to the qualified voters of Shelby County at the next Countywide election allowed by law, and the Shelby County Election Commission, in accordance with the state election laws, is hereby directed to publish the proposed amendment which reads as follows:

PROPOSED AMENDMENT I:

Shall the Shelby County Charter be amended at Section 5.24(A) Recall of elected County officials to add language providing for recall of County school board members as governed by the laws of the State of Tennessee?

Section 5.24. - Recall of elected County officials.

A. The County mayor, members of the board of County commissioners, and all County Charter officers elected pursuant to this Charter, and school board members of the County school board, where authorized by state law, may be removed from office by the recall method provided for in Title 2 of the state election laws and in accordance with this section, but in no event shall such County officials be subject to recall during the first one hundred eighty (180) days or the last one hundred eighty (180) days of the term for which such County officials were elected.

PROPOSED AMENDMENT II:

Shall the Shelby County Charter be amended at Article VI, Section 6.02(A) to apply recall provisions to the County school board members as governed by the laws of the State of Tennessee?

Section 6.02. County board of education.

A. The provisions of this charter shall not apply to County school funds or to the County board of education, or the County superintendent of education for any purpose:

(1)               Except that all such employees and officials shall be residents of Shelby County as a condition for employment or service as applicable; provided, any employee or official employed as of the effective date of this charter shall not have to comply with this requirement.

(2)               Except as provided in section 2.06(C)(3)(e).

(3)               Except as provided in section 5.24(A).

B. The existing private act enabling legislation (Chapter 381 of the Private Acts of 1923, as amended) shall remain in full force and effect for education purposes, except as modified in this section.

BE IT FURTHER ORDAINED, That an affirmative response from the voters would amend Article II of the Shelby County Charter as stated above.

BE IT FURTHER ORDAINED, That upon receipt of the proclamation from the Secretary of State showing the results of such referendum election on the adoption or rejection of the proposed Charter amendment, the Shelby County Election Commission shall (1) attach one copy of the proclamation to the copy of the proposed Charter amendment theretofore certified to the Secretary of State and (2) deliver one copy of the proclamation to the Shelby County Clerk who shall attach same to the copy of the referendum returns and proposed Charter amendment theretofore certified to, and deposited with, the Shelby County Clerk; and the Shelby County Clerk subsequently delivering the proclamation and all attachments thereto to the Clerk of the Shelby County Board of Commissioners who shall make it a part of the minutes.

BE IT FURTHER ORDAINED, That if any clause, section, paragraph, sentence or part of this Ordinance shall be held or declared to be unconstitutional and void, it shall not affect the remaining parts of this Ordinance, it being hereby declared to be the legislative intent of the Shelby County Board of Commissioners to have passed the remainder of this Ordinance notwithstanding the part so held unconstitutional and void, if any.

BE IT FURTHER ORDAINED, That all laws constituting the present Shelby County Charter that are not in conflict with the Charter amendments proposed herein be and the same are hereby continued in full force and effect, and all laws in conflict therewith be and the same are hereby repealed if the voters vote in favor of the amendment proposed herein.

BE IT FURTHER ORDAINED, That this Ordinance requires a two-thirds vote of the membership of the Board of County Commissioners and shall take effect upon adoption pursuant to Article V, Section 5.05(B), the public welfare requiring same.

ORDINANCE NO. 584

ORDINANCE TO AMEND THE SHELBY COUNTY CODE OF ORDINANCES, CHAPTER 16, ARTICLE IV, TO PROVIDE FOR THE ESTABLISHMENT OF AN ADMINISTRATIVE FEE TO BE IMPOSED BY THE SHELBY COUNTY LAND BANK FOR THE PRIVATE LOT GRASS MAINTENANCE PROGRAM. SPONSORED BY COMMISSIONER HENRI E. BROOKS.

 WHEREAS, Shelby County Government controls harmful vegetation pursuant to the Control of Harmful Vegetation Ordinance, found in Chapter 16 (Environment), Article IV, Sections 16-111 through 16-119 of the Shelby County Code of Ordinances; and

 WHEREAS, Shelby County Code of Ordinances, Section 16-111(b), states that, “The board of County commissioners is authorized to compel the owner of any property in the County lying outside the boundaries of an incorporated municipality to cut or destroy rank weeds, grasses or other underbrush. The board may also upon the failure of the owner, occupant or tenant, to cut or destroy such weeds, grasses or other underbrush, or in case the owner of the property is unknown, to cut or destroy such weeds, grasses or other underbrush.”; and

 WHEREAS, Shelby County Code of Ordinances, Section 16-113, requires the removal of harmful vegetation by assessing properties, serving written notices on properties in violation, and remediating properties that fail to cut or cause to be cut harmful vegetation on the property within 10 days; and

 WHEREAS, Pursuant to Shelby County Code of Ordinances, Section 16-114 (a), an itemized statement or bill for costs incurred by the County to remove or control weeds, grass or noxious growth shall be sent via U.S. mail to the property owner for payment, and if the statement is not paid within 30 days, the costs of the same shall be certified to the County trustee and a lien shall be placed upon the property; and

 WHEREAS, Considerable administrative effort is required to enforce the Control of Harmful Vegetation Ordinance, which costs are more particularly described in the listing thereof, attached hereto as Exhibit A, and incorporated herein by reference, and the cost is most appropriately borne by the owners of properties in violation of the Control of Harmful Vegetation Ordinance and not the citizens of Shelby County; and

 WHEREAS, Pursuant to Sections 1.01 and 1.02 of the Charter of Shelby County, the Shelby County Government is authorized to exercise any power to perform any function which is not denied by the Constitution of the State of Tennessee and is further granted all lawful powers with regards to private and local affairs except those powers reserved to the judiciary; and

 WHEREAS, Pursuant to the authority granted by the Charter of Shelby County, the Board of Commissioners of Shelby County has determined that certain fees should be imposed for the assessment, serving of written notices, and remediation by Shelby County of properties in violation of the Control of Harmful Vegetation Ordinance; and

 WHEREAS, The Board of Commissioners of Shelby County has determined that ratification of an Administrative Fee to be used for defraying these expenses will be in the best interest of Shelby County, Tennessee; and

 WHEREAS, A fee of One Hundred and Eighty Dollars ($180.00) per each property required to be cut by Shelby County to enforce the Control of Harmful Vegetation Ordinance will adequately compensate Shelby County for the assessment, serving of written notices, and remediation by Shelby County of properties in violation of the Control of Harmful Vegetation Ordinance; and

 WHEREAS, Actual costs of assessment, serving of written notices, and remediation by Shelby County of properties in violation of the Control of Harmful Vegetation Ordinance vary annually and the fee will need to be reassessed each fiscal year.

 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF SHELBY COUNTY, TENNESSEE, That the Shelby County Land Bank is hereby authorized to charge a fee of One Hundred and Eighty Dollars ($180.00) per each property required to be cut by the County to enforce the Harmful Vegetation Ordinance, to be reassessed annually and not to exceed Two Hundred and Fifty Dollars ($250.00).

 BE IT FURTHER ORDAINED, That Section 16-114 of the Shelby County Code of Ordinances is amended by adding a newly designated subsection (c), which shall read as follows:

(c) Included in the itemized statement of costs to remove or control weeds, grass or noxious growth on a property as described in Section 16-114(a), the owner of the property shall also pay to the Shelby County Government an assessment and remediation fee in the sum of $180.00 for each cut performed by the County, with the fee amount to be reassessed annually by the Administrator of the Land Bank Department, based on actual costs to be expended by Shelby County Government, and not to exceed $250.00.

 BE IT FURTHER ORDAINED, That this Ordinance shall become effective in accordance with the Shelby County Charter, Article II, Section 2.06(C).

However, neither the legislative branch nor the chairman of the legislative branch shall exercise executive, administrative or judicial powers or perform any functions of the mayor-County commission government delegated or assigned by the terms of this charter to other offices, branches or departments of County government. Whenever any public or private act of the state purports to authorize the County court or County commission or its chairman to perform any administrative or executive act or function, then such act or function shall be performed by the County mayor.

ORDINANCE NO. 582

ORDINANCE FIXING THE TAX RATE FOR SHELBY COUNTY, TENNESSEE AT $2.69 FOR TAX YEAR 2025 (FISCAL YEAR 2026). SPONSORED BY COMMISSIONER MISKA CLAY BIBBS AND CHAIRMAN MICHAEL WHALEY.

WHEREAS, Tennessee Code Annotated, Section 67-1-601, authorizes counties in Tennessee to impose taxes for County purposes, and to fix the rates thereof; and

WHEREAS, Pursuant to Tennessee Code Annotated, Section 67-5-510, and the legislative authority set forth in Article II, Section 2.01, of the Shelby County Charter, it is the duty of the Shelby County Board of Commissioners to set a Tax Rate for the Tax Year 2025 at this time; and

WHEREAS, The 2025 Tax Rate shall be allocated and apportioned to the designated funds of the County Government as follows:

 EDUCATION FUND $1.19

 COUNTY GENERAL FUND $1.20

 DEBT SERVICE FUND .30

 TOTAL  $2.69

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF SHELBY COUNTY, TENNESSEE, That the Tax Rate for Shelby County for the Tax Year 2025 be and the same is hereby fixed at $2.69 for each One Hundred Dollars ($100.00) of taxable real and personal property in the County.

JOINT ORDINANCE OF THE SHELBY COUNTY BOARD OF COMMISSIONERS AND MEMPHIS CITY COUNCIL ESTABLISHING THE MEMPHIS-SHELBY COUNTY BUILDING HOME PROGRAM PURSUANT TO THE TENNESSEE HOMESTEAD ACT WITHIN CHAPTER 281 OF THE PUBLIC ACTS OF 1985. SPONSORED BY COMMISSIONER ERIKA SUGARMON, COMMISSIONER BRITNEY THORNTON, COMMISSIONER MICKELL LOWERY, COMMISSIONER HENRI E. BROOKS, COMMISSIONER BRANDON MORRISON AND COMMISSIONER SHANTE K. AVANT.

WHEREAS, There exists great need to address disparities in access to safe, quality housing choice and improve access to wealth-building opportunities for residents of Memphis and Shelby County; and

WHEREAS, The Shelby County Delegation introduced HB410/SB452, an Act to Enact the “Tennessee Homestead Act”, in the 1985 Legislative Session; and

WHEREAS, The “Tennessee Homestead Act” was approved by the General Assembly on April 25, 1985, for the disposition of real properties owned by local governments, and signed by the Governor of Tennessee on April 30, 1985, and is now designated as Chapter 281 of the Public Acts of 1985 and codified as Tennessee Code Annotated, Section 7-66-101 et seq.; and

WHEREAS, The Joint Memphis and Shelby County Division of Planning and Development through its Department of Housing desires to establish the “Building Home Program” to provide enhanced access to quality housing choice across Memphis and Shelby County; and

WHEREAS, Ordinance 345 of the Shelby County Board of Commissioners adopted September 24, 2007, established the Land Bank Department to maintain and manage properties obtained by Shelby County Government and in doing so transferred the formerly designated Homestead Program to the Land Bank Department; and

WHEREAS, Article III, Section 3.06 D. of the Shelby County Charter authorizes the Board of County Commissioners to establish the duties, powers, and functions of departments within divisions of the Shelby County Government by ordinance; and

WHEREAS, It is the desire of The Board of Commissioners of Shelby County that functions related to the formerly designated Homestead Program should be assumed by the Division of Planning and Development; and

WHEREAS, It is the desire of the Memphis City Council to jointly support the functions related to the formerly designated Shelby County Homestead Program through the joint Division of Planning and Development; and

WHEREAS, Tennessee Code Annotated, Section 7-66-105 requires the adoption of an implementation plan by the mayor, “which shall be subject to majority approval by the local [governing] body”; and

WHEREAS, The Building Home Program Implementation Plan attached hereto as Exhibit A, and incorporated herein by reference, serves as a program component to activate underutilized parcels currently held by Shelby County Government and the City of Memphis; and

WHEREAS, The Building Home Program Implementation Plan shall be incorporated herein in its entirety and any future amendments to said Plan are subject to Joint Ordinance; and

WHEREAS, Tennessee Code Annotated, Section 13-23-301 establishes the ability for the “Tennessee housing development agency (THDA)” to administer “a homebuyers’ revolving loan fund pool for participating… counties” and Section 13-23-302 allows counties to use its respective local portion of the loan fund pool for homebuyers; and

WHEREAS, Shelby County operates a loan program initially established as the Homebuyers Revolving Loan Program by Resolution No. 9 adopted July 21, 1986; and

WHEREAS, Expanded loan product offerings are an identified community need and can help address housing disparities.

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF SHELBY COUNTY, TENNESSEE AND THE CITY COUNCIL OF THE CITY OF MEMPHIS, That the “Building Home Program” is hereby established to address housing-related needs for the citizens of Memphis and Shelby County pursuant to the authorities of the Tennessee Homestead Act of 1985.

BE IT FURTHER ORDAINED, That the “Building Home Program Implementation Plan”, which is attached hereto and incorporated herein by reference as Exhibit A, is hereby approved and adopted and may be amended by Joint Ordinance of the Shelby County Board of Commissioners and the Memphis City Council.

BE IT FURTHER ORDAINED, That Ordinance No. 345 of the Shelby County Board of Commissioners adopted September 24, 2007, is hereby amended to assign all functions and duties related to the formerly designated Shelby County Homestead Program to the Division of Planning and Development with concurrence of the Memphis City Council.

BE IT FURTHER ORDAINED, That the Division of Planning and Development shall establish policies and procedures including setting application fees and required deposit amounts necessary to administer the Building Home Program which may be amended from time to time by the administering agency.

BE IT FURTHER ORDAINED, That the Homebuyers Revolving Loan Program established by Resolution No. 9 adopted July 21, 1986, by the Shelby County Board of Commissioners may be utilized for expanded loan products for the Building Home Program subject to State of Tennessee requirements governing the use of Shelby County homebuyers revolving loan funds and its subsequent amendments.

BE IT FURTHER ORDAINED, That for properties owned by Shelby County Government, the County Mayor is hereby authorized as the proper official to authorize and execute any and all contractual agreements, administrative forms, and documents as required and necessary for the successful completion of the Building Home Program.

BE IT FURTHER ORDAINED, That for properties owned by the City of Memphis, the City of Memphis Mayor is hereby authorized as the proper official to authorize and execute any and all contractual agreements, administrative forms, and documents as required and necessary for the successful completion of the Building Home Program.

BE IT FURTHER ORDAINED, That the County Mayor is hereby authorized as the proper official to authorize and execute any and all contractual agreements, administrative forms, and documents as required and necessary for the successful completion of the Homebuyers Revolving Loan Program.

BE IT FURTHER ORDAINED, That if any clause, section, paragraph, sentence or part of this Joint Ordinance shall be held or declared to be unconstitutional and void, it shall not affect the remaining parts of this Ordinance, it being hereby declared to be the legislative intent of the Shelby County Board of Commissioners and the City Council of the City of Memphis to have passed the remainder of this Ordinance notwithstanding the part so held unconstitutional and void, if any.

BE IT FURTHER ORDAINED, That this Joint Ordinance requires a two-thirds vote of the membership of the Board of County Commissioners pursuant to the Shelby County Charter.

BE IT FURTHER ORDAINED, That this Joint Ordinance shall take effect in accordance with the Charter for the City of Memphis.
