Circuit Court Filings Up in Fourth Quarter

Filings in Circuit Court were up for the last quarter of 2012 but down in Chancery and Probate Courts compared to the fourth quarter of 2011.
The quarterly numbers from The Daily News Online, www.memphisdailynews.com, showed a 15 percent increase with the 2,030 filings compared to 1,726 a year ago across the three civil courts.
Hospital liens filed by hospitals on insurance money paid to patients were the top category in Circuit Court for the last three months of 2012 with 867 such claims.
They were followed by 296 divorce filings with and without children and 283 auto accident claims.
Hospital liens and divorces were the top two categories in fourth quarter 2011 with 428 in each category followed by 331 auto accident claims.
Filings in Chancery Court dropped 31.7 percent from the same quarter a year ago with 352 cases filed compared to 515 in fourth quarter 2011.
The 132 divorce filings – with and without children – were the top category followed by 43 workers compensation claims and 32 breach of contract complaints.
There were 236 Probate Court filings across the court’s four categories in the fourth quarter. That compares to 260 in the same period a year ago for a 9.3 percent decrease.
Wills were the top category with 136 filed followed by 48 administrators appointed and 44 conservators. There were eight requests for guardians file.
