Mid-South Wendys owner Mid-South Wendys owner settles ADA lawsuit A settlement was reached in a lawsuit charging Valenti Mid-South Management LLC, owner of 54 Wendys restaurants in West Tennessee, North Mississippi, East Arkansas and Southeast Missouri, violated the Americans with Disabilities Act. In December 1999, Jason Perkins filed a complaint in U.S. District Court against the owner of a Memphis Wendys alleging violations under the ADA due to a lack of access to restrooms by people using wheelchairs. The U.S. Attorneys Office, working with the Civil Rights Division of the Department of Justice, intervened in the case and commenced negotiations with Valenti to resolve the complaint. Under the consent decree filed with the Memphis district court April 30, Valentis restaurants will undergo comprehensive modifications to improve access by people with disabilities. Some of the modifications include widening doors leading into restrooms, adding or remounting grab bars adjacent to toilets, raising restroom toilets and sinks and installing new condiment and service counters. The consent decree also provides for damages in the amount of $25,000 be paid to Perkins. Assistant U.S. attorneys Harriett Miller Halmon and Gary Vanasek for the Western District of Tennessee handled the case. "The management of Valenti Mid-South Management LLC worked cooperatively with government attorneys throughout negotiations and actually began work on some modifications before reaching a full agreement including replacement of all customer service lines to provide wider aisles to accommodate people using wheelchairs," said Larry Laurenzi, U.S. Attorney for the Western District of Tennessee.
