NEW YORK (AP) – Mall operator Simon Property boosted its hostile bid for rival Macerich by 5 percent to $16.8 billion and said it will be its best and final offer.

The proposed deal would combine two of the largest U.S. shopping mall operators.

The retail business has been described in recent times as Darwinian in nature to those in the industry, meaning formats come and go as competition intensifies each year.

That concept is apparent in retail chains having trouble finding the best real estate for new locations as antiquated strip centers retain high vacancies. Or in the resurgence of upscale retailers, while dollar stores are simultaneously expanding at a rapid clip.

Oak Court Mall and Wolfchase Galleria have been assigned new general managers, Indianapolis-based Simon Property Group Inc. said Thursday.

Simon Property Group Inc. has selected Grubb & Ellis Memphis as the leasing agent for Oak Court Drive, a 136,000-square-foot Class A office building on Poplar Avenue in East Memphis.

Grubb & Ellis president Joe Steffner and vice president Greg deWitt will handle the leasing for the property, which sits next to Oak Court Mall and currently has up to 13,000 square feet of contiguous space with smaller suites available for other prospective tenants.

22. Simon Says It Improved Offer For Rival -

INDIANAPOLIS (AP) – Mall owner Simon Property Group says it has improved its offer to help finance the bankruptcy exit of its biggest rival, General Growth Properties.

The Indianapolis company, which owns and operates Oak Court Mall and Wolfchase Galleria, will backstop a $1.5 billion credit facility General Growth needs to emerge from bankruptcy, waive a $12.5 million fee and limit its governance rights.

David Simon, chairman and CEO of the nation’s largest public real estate firm, told analysts a few weeks ago during Simon Property Group’s fourth quarter earnings conference call that 2009 was a challenging year. And he doesn’t think 2010 will be much better for the company, which owns two malls in Memphis.

INDIANAPOLIS (AP) – The nation’s largest shopping mall owner, Simon Property Group, made a $10 billion hostile bid Tuesday to acquire its ailing rival, General Growth Properties.

Simon has a large footprint in Memphis, where the company owns 94.5 percent of Wolfchase Galleria in Cordova and 100 percent of Oak Court Mall in East Memphis, two of the most successful area malls.

Retail Web sites have bumped back deadlines and offer free express shipping after weekend snowstorms kept holiday shoppers home in large areas of the East Coast.

Meanwhile, some bricks-and-mortar stores are extending early morning bargains that had been offered on Saturday through Wednesday.

In a sign of the rattled state of commercial property owners amid the lingering downturn, the owners of most of Shelby County’s major shopping malls are contesting their 2009 property appraisals.

The new values, which will determine the properties’ tax bills, were sent out earlier this year as part of the 2009 countywide reappraisal of property. The area’s five most prominent shopping centers – Wolfchase Galleria, The Avenue Carriage Crossing, Oak Court, Raleigh Springs Mall and Southland Mall – all saw their appraisals rise this year.

32. Mid-America Establishes $500 Million Acquisition Fund -

Memphis-based Mid-America Apartment Communities Inc. has announced plans to ramp up its multifamily investments through a newly established fund called Mid-America Multifamily Fund I LLC.

The fund, a joint venture between Mid-America and institutional capital, will target investment opportunities within the company's existing Sunbelt markets. Mid-America will own a 33 percent interest in the fund with plans to acquire $500 million of multifamily properties during the next three years.

A neighborhood on the edge of Downtown is seeing some growth, the newest of which is a black repertory theater.

The 70-seat, 3,200-square-foot Hattiloo Theater is scheduled to open Sept. 22 at 656 Marshall Ave. and will focus on black theater and art. The building belongs to Pinkney Herbert, the owner of the Marshall Arts gallery at 639 Marshall.

39. Wolfchase Galleria Withdraws Tax Appeal -

A dispute over the appraisal of Wolfchase Galleria, the largest single source of property taxes in Shelby County, is officially over.

Tax representatives for the 1.1 million-square-foot retail behemoth have withdrawn an appeal to the state assessment appeals commission after taking their case before an administrative judge in January. They were working to get the $132 million appraisal for Wolfchase, which is owned by Simon Property Group Inc., nearly cut in half to about $73 million. Simon also owns Raleigh Springs Mall and Oak Court Mall in Memphis.
